Interpretation and Definitions
Capitalized words throughout this document have specific meanings, which are laid out below. They apply the same way whether they're singular or plural. Here's what we mean by the key terms: • Affiliate means any entity that controls, is controlled by or is under common control with Magic Pilot. • Country refers to: Washington, United States • Company (sometimes called "the Company", "We", "Us" or "Our") is Magic Pilot itself. • Device is anything that can access the Service like a computer, phone or tablet. • Service is the Magic Pilot Website. • Terms and Conditions (also just "Terms") is this entire agreement between you and Magic Pilot about how you use the Service. • Third-party Social Media Service means services or content from other companies that may show up or be available through the Service. • Website is Magic Pilot's site. • You is the person accessing or using the Service, or the company or legal entity they're doing it for.
Acknowledgment
These Terms and Conditions govern how you use Magic Pilot and form the agreement between you and the Company. They spell out what everyone using the Service can and can't do. Your access to the Service depends on you accepting these Terms and following them. They apply to everyone who visits, uses or accesses the Service. By using the Service you're agreeing to follow these Terms and Conditions. If you don't agree with any of it, you can't use the Service. You're confirming that you're at least 18 years old. Magic Pilot doesn't let anyone under 18 use the Service.
Links to Other Websites
Magic Pilot might include links to third-party websites or services that the Company doesn't own or run. We don't control those sites and can't be responsible for their content, privacy practices or anything else they do. You also agree that the Company isn't liable for any damage or loss that happens because you used or relied on content, goods or services from those other websites.
Termination
We can terminate or suspend your access right away, without notice or warning, for any reason at all—especially if you break these Terms and Conditions. Once that happens, your ability to use the Service stops immediately.
Limitation of Liability
No matter what damages you might suffer, the Company and its suppliers' total liability under these Terms is capped at whatever you actually paid us through the Service, or 100 USD if you haven't bought anything. To the fullest extent the law allows, the Company and its suppliers aren't liable for any special, incidental, indirect or consequential damages (including lost profits, lost data, business interruption, personal injury, privacy loss or anything else related to your use or inability to use the Service, third-party software or hardware, or anything in these Terms), even if we knew it might happen and even if the remedy doesn't work.
"AS IS" and "AS AVAILABLE" Disclaimer
The Service is given to you as-is and as-available, with all its faults and issues, with no guarantees of any kind. As much as the law lets us, the Company and its Affiliates, licensors and service providers disclaim all warranties—whether express, implied, written or otherwise—about the Service, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranties from how you've been dealing with us. The Company and its providers don't make any representation or warranty of any kind, express or implied: (i) about whether the Service works or is available, or about the information, content, materials or products on it; (ii) that the Service won't be interrupted or have errors; (iii) about the accuracy, reliability or freshness of any information on the Service; or (iv) that the Service, its servers, the content or emails from the Company are free of viruses, scripts, trojans, worms, malware or other harmful stuff.
Governing Law & Disputes Resolution
The laws of the Country, not including its conflict of law rules, apply to these Terms and your use of the Service. You might also be subject to other local, state, national or international laws depending on where you are. If you have a problem or dispute with the Service, you agree to try working it out informally with the Company first.
Compliance & Regulations
For European Union (EU) Users: As an EU consumer, you get the benefit of any mandatory consumer protections in your country. United States Legal Compliance: You confirm that (i) you're not in a country under US embargo or designated as supporting terrorism, and (ii) you're not on any US government prohibited or restricted parties list.
Severability and Waiver
If any part of these Terms ends up being unenforceable or invalid, that part will be modified or interpreted to match the original intent as much as possible under the law, and the rest of the Terms stay in effect. Except as stated here, if we don't enforce a right or require someone to follow an obligation, that doesn't mean we've given up the right to enforce it later. And waiving one breach doesn't mean we're waiving the next one.
Changes to These Terms and Conditions
These Terms might have been translated if we've made them available in other languages on the Service. The original English version takes priority if there's any dispute. We can modify or replace these Terms whenever we want at our discretion. If the change is significant we'll try to give you at least 30 days' notice before the new terms kick in. If you keep using the Service after that date, you're agreeing to the new terms. These terms and conditions went into effect on August 6, 2026
